MINNESOTA PUBLIC EMPLOYEES ASSOCIATION LEGAL DEFENSE PLAN
The Minnesota Public Employees Association provides legal services to our members. This MNPEA Legal Defense Plan (MNPEA LDP) covers the following areas:
- Criminal Charges – Trial & Defense: Complete legal representation for criminal charges both on and off duty within the State of Minnesota for Member’s not covered by the National Fraternal Order of Police Legal Defense Plan. No attorney’s fees required. Coverage includes all stages of initial criminal process, from pre-charging to sentencing. Criminal charges involving methamphetamine are expressly not covered by MNPEA LDP. Post-Trial Appeal and Motions may be covered by MNPEA LDP following board approval. All costs associated with the MNPEA LDP, excluding attorney’s fees, shall have a cap of $5,000. Additional fees shall be the responsibility of the Member.
MNPEA Members and their spouse are eligible for this coverage.
- Motor Vehicle Criminal and Traffic Violation: Complete legal representation for traffic violations within the State of Minnesota, whether job related or not. No attorney’s fees required. Coverage includes all stages of initial criminal process, from pre-charging to sentencing. Post-trial Appeal and Motions may be covered by MNPEA LDP following board approval. All costs associated with the MNPEA LDP, excluding attorney’s fees, shall have a cap of $5,000. Additional fees shall be the responsibility of the Member.
MNPEA Members are eligible for this coverage.
- Defense of Job-Related Employment/Administrative or Civil Proceedings: Complete legal representation for defense of administrative or employment cases relating to termination, demotion, suspension or other disciplinary action by the Member’s employer. Appeals to Minnesota State Appellate Courts and Federal Courts are not covered but may be approved by the board. The MNPEA LDP also provides complete legal representation for defense of civil proceedings for work related incidents within the State of Minnesota. “Work related” means incidents occurring as a part of the Member’s public employment. Coverage is also provided if the conduct giving rise to civil proceedings occurs outside of Member’s workplace but is substantially related to their employment capacity. This coverage is excluded if Member’s employer indemnifies the Member or offers legal representation for them. All costs associated with the MNPEA LDP, excluding attorney’s fees, shall have a cap of $5,000. Additional fees shall be the responsibility of the member, but the board may also approve to cover some fees.

- Wills, Trusts and Estates Coverage: Members and anyone within their household are eligible for discounted rates for legal wills and trusts.

- Discounted Rates: Members are also eligible for discounted rates for other legal services as determined by MNPEA’s In-House Attorneys Joe Ditsch and Alec Rolain. This is not a guarantee that additional legal services can or will be provided, but that they may be available.

- Excluded Coverage:
- Pre-Existing conditions prior to Member’s membership with MNPEA. If an employee is covered by Employer Indemnification without MNPEA Membership, they will be covered by MNPEA LDP if the Employer Indemnification ends and they become a MNPEA member prior to that time.
- Matters, claims or defense pertaining to any matter listed herein to which the MNPEA Board determines frivolous or without proper merit.
- Any matter that MNPEA’s In-House Attorneys are unable to provide legal counsel on for purposes of their Minnesota Rules of Professional Conduct.
- Duty of Fair Representation claims.
